TERMS & CONDITIONS – FRAME ATLAS PHOTO WORKSHOP (EN)
1. Scope and contracting parties
These Terms & Conditions (“T&C”) govern only the photography workshop services provided by Frame Atlas (“FA”, “we”).
The tour also includes travel services such as accommodation and transport (and related services) which, once the tour is confirmed, are arranged, sold, and invoiced exclusively by [ Travel agency details ] under separate contractual terms.
2. Mandatory two-contract structure
Participation in the tour requires:
a) a workshop contract with Frame Atlas (training, photographic guidance, educational activities); and
b) a separate travel contract with [ Travel agency details ](accommodation/transport and logistics), which becomes effective once the tour is confirmed.
It is not possible to participate by purchasing only one component.
3. Minimum number of participants (tour-specific)
Each tour has a minimum number of participants, clearly stated on the tour information page (or in the confirmation notice).
The tour is confirmed only after formal notice (email or tour page update).
If the minimum number is not reached, Frame Atlas may cancel the tour. In such case, the Frame Atlas deposit will be fully refunded and no obligation arises to purchase or pay for the travel portion.
After tour confirmation, any cancellations/changes related to the travel portion (accommodation/transport) are governed by [ Travel agency details ] and by the relevant booking/invoice documents.
4. Booking and deposit
A 30% deposit of the Frame Atlas workshop fee is required to secure a seat. The seat is reserved once the deposit is received.
5. Tour confirmation and refund if not confirmed
The tour is confirmed only after formal notice (email or tour page update).
If the tour is not confirmed, the Frame Atlas deposit will be fully refunded.
6. Payments – Frame Atlas workshop fee
6.1 Deposit: 30% to secure the seat.
6.2 Workshop balance: the remaining workshop fee must be paid to Frame Atlas no later than 60 days before departure.
6.3 Any bank fees or payment processing charges are borne by the participant unless stated otherwise.
7. Payments – travel services (Agency)
7.1 Once the tour is confirmed, [ Travel agency details ] issues a separate invoice for the travel portion (accommodation, transport, and included travel services).
7.2 The Agency invoice must be paid within 10 days of issuance (or by the due date stated on the invoice).
7.3 Failure to pay the Agency invoice by the deadline may lead to cancellation of the travel booking under the Agency’s terms. In such case, the Frame Atlas workshop booking is considered void, the 30% deposit is non-refundable, and the seat may be reallocated and offered for sale again.
7.4 Seat reallocation: Frame Atlas may reallocate the seat to another participant. Any exception (e.g., partial refund if a replacement is found) is at Frame Atlas’ discretion and must be confirmed in writing.
8. Flights
Flights are not included. They must be booked and paid directly by participants, only after tour confirmation.
Frame Atlas does not refund flight costs; any refund depends on the airline’s rules and/or the participant’s insurance.
9. Insurance (mandatory)
Participation requires appropriate insurance coverage, including at least:
- trip cancellation insurance
- medical and accident coverage abroad
- repatriation
- personal liability insurance
The participant is responsible for checking coverage, limits, deductibles, and exclusions. Frame Atlas may request proof of coverage before departure.
Any reimbursement due to inability to travel depends solely on the participant’s insurance policy.
10. Travel documents (participant responsibility)
It is the participant’s responsibility to hold valid and required travel documents (passport/ID, visas, permits, health certificates/vaccinations where required, etc.).
Missing or non-compliant documents do not entitle the participant to any refund from Frame Atlas.
11. Participant duties, safety and conduct
11.1 The participant agrees to follow the organisational and safety instructions provided by Frame Atlas and/or local partners, as well as the rules of venues and locations visited.
11.2 The participant is responsible for their own health, physical fitness, and for bringing appropriate equipment (clothing, footwear, protective gear, etc.) according to expected conditions.
11.3 Dangerous, aggressive, illegal behaviour, or conduct that endangers the group may lead to exclusion from the workshop, without any right to a refund of the workshop fee, without prejudice to any further legal rights.
12. Program changes, weather and force majeure
12.1 Frame Atlas may adjust times, locations, and workshop content due to weather, safety, accessibility or operational reasons, and will offer reasonable alternatives consistent with the workshop’s educational purpose.
12.2 Weather and natural conditions (clouds, rain, wind, tides, visibility, snow, the absence of desired phenomena such as aurora, etc.) are not guaranteed and do not entitle the participant to any refund of the workshop fee.
12.3 Force majeure means unforeseeable events beyond the reasonable control of the parties (e.g., natural disasters, sudden closures, government restrictions, strikes, civil unrest, health emergencies, transport disruptions, etc.). In such cases Frame Atlas may adapt the workshop, propose alternatives or reschedule, with no obligation to refund except as provided in section 13.
13. Inability to deliver due to Frame Atlas (e.g., instructor illness)
If Frame Atlas cannot deliver the workshop due to reasons attributable to Frame Atlas (e.g., instructor illness or serious impediment), Frame Atlas will offer, at the participant’s choice:
a) a full refund of the workshop amounts paid; or
b) rebooking to a new date/equivalent trip (subject to availability).
The travel portion remains governed by [ Travel agency details ]; Frame Atlas cannot guarantee refunds or changes for that component.
14. Participant cancellation – Frame Atlas workshop fee
14.1 General rule
If a participant cancels or does not attend, including due to illness, injury, or any personal reason, there is no automatic right to a refund. Any reimbursement depends on the participant’s insurance.
14.2 Cancellation fees (Frame Atlas workshop fee)
For voluntary cancellations, the following fees apply to the workshop fee:
- up to 90 days before departure: 100% refund
- 89–60 days: 30% fee
- 59–30 days: 50% fee
- 29–15 days: 75% fee
- 14–0 days: 100% fee
14.3 Name change
If the participant finds a suitable replacement, Frame Atlas may accept a name change (subject to review and logistical feasibility) and may charge a reasonable administration fee. TS Travel Smart GmbH’s terms apply to the travel portion (Agency T&C: https://www.senseoftravel.ch/agb/).
15. Equipment, personal items and responsibility
Participants are responsible for their own photographic equipment and personal belongings. Frame Atlas is not liable for theft, loss, or damage to personal property.
16. Complaints and notifications
Any issues relating to the workshop must be reported immediately during the tour to Frame Atlas to allow an on-site solution where possible.
Any complaints must be submitted in writing within 30 days after the end of the workshop, clearly describing the issue and including supporting documentation where available. After this period, claims are deemed forfeited to the extent permitted by law.
17. Liability
Frame Atlas is liable only for its workshop services and within the limits permitted by law. Liability for travel services (accommodation, transport, etc.) lies with [ Travel agency details ] and/or the relevant suppliers under their respective contracts and terms.
18. Privacy and use of images
During the workshop, photos and/or short “behind-the-scenes” recordings may be made for Frame Atlas documentation and promotional purposes (website, social media, informational materials).
Participants may request at any time not to be photographed/filmed and/or not to appear in published content (“opt-out”) by notifying Frame Atlas in writing or directly during the workshop. Frame Atlas will take reasonable measures to comply.
Personal data is processed in accordance with the applicable privacy policy published on the Frame Atlas website.
19. Governing law and jurisdiction
Unless mandatory law provides otherwise, Swiss law applies. Place of jurisdiction: Zurich, Switzerland.
